Could a Person Be Criminally Liable in Betting the Illegal Last Two and Other Illegal Numbers Games?

Last Two is an illegal numbers game where the winning combination is derived from the last two (2) numbers of the first prize of the winning Sweepstakes ticket which comes out during the weekly draw of the Philippine Charity Sweepstakes Office (PCSO), and its variants.

Today, last two is not only derived from the weekly draw of PCSO but from the popular LOTTO games.

As a matter of fact, sometimes the queue would be likened to a box-office hit movie because these games really draw a magnitude of people.

However, not all people hooked with lotto games would find themselves betting in authorized lotto outlets.  Most of them would bet on illegal numbers games of last two and most often than not in persons called collectors of last two.

Who are bettors?

Bettor ("Mananaya", "Tayador" or variants thereof) is any person who places bets for himself/herself or in behalf of another person, or any person, other than the personnel or staff of any illegal numbers game operation. 

These people patronizing the illegal last two do not know that they have already transgressed a law.  

Who are collectors?

Collector or Agent ("Cabo", "Cobrador", "Coriador" or variants thereof) is any person who collects, solicits or produces bets in behalf of his/her principal for any illegal numbers game who is usually in possession of gambling paraphernalia.

It is not only the collector or agent that is penalized in our law.

Republic Act Number 9287 penalizes not only the collector but as well the bettor of illegal numbers games.

Accordingly, a person who acts as BETTOR shall be imprisoned from thirty (30) days to ninety (90) days.

While a person who acts as an agent or collector of illegal numbers games shall be penalized with an imprisonment from eight (8) years and one (1) day to ten (10) years.

Take note that these are criminal offenses.  They would affect a person's record in the Police and even in the National Bureau of Investigation or NBI.

To avoid the hassle of being criminally charged, better refrain from betting to any illegal numbers games.

Bonds for Illegal Gambling

This post shall provide the updated recommended bonds for illegal gambling as of this writing. Presidential Decree No. 1602 (Prescribing Stiffer Penalties on Illegal Gambling): Section 1.   Penalties.  The following penalties are hereby imposed: (a) The penalty of prison correccional in its medium period of a fine ranging from one thousand to six thousand pesos, and in case of recidivism, the penalty of prision mayor in its medium period or a fine ranging from five thousand to ten thousand pesos shall be imposed upon:      1.
