Could Mommy Dionisia Marry Her 40-Year Old Boyfriend?

Mommy Dionisia Pacquiao or Mommy D is now in the spotlight again. It is not because she was one of the ten personalities who were voted as the best dressed in the 5th State of the Nation Address (SONA) of Philippine President Benigno S. Aquino III but it is because of the rumor that she plans to marry her 40-year old boyfriend.
Recently, it was no less than the world boxing icon Sarangani Representative Manny Pacquiao who divulged such information that Mommy D is now on the marrying stage again.
The question now is would Mommy D have no legal impediment to marry her boyfriend.
Accordingly, Mommy D is previously married to another man. And this man is not even Manny's father. As a matter of fact, Mommy D and Manny's father were just common-law spouses or commonly known as live-in partners because of Mommy D's previous marriage.
Unfortunately, Mommy D and Manny's father eventually lived separately without leveling up their relationship.
As for today, despite the separation-in-fact of Mommy D and her legal husband for quite sometime now, Mommy D is still married. Her separation to her husband, regardless how long it may be, would not severe her marriage tie with him.
The marriage contract is a special one as compared to ordinary form of contracts. Its dissolution would not be based to inaction or at the mercy of either of both parties. To dissolve a marriage contract, there must be an order of the court for that purpose.
Granting, of course, that the legal husband of Mommy D is still alive today. Mommy D nor Manny did not divulge yet any information as to the whereabouts of Mommy D's husband. So, there is no information as of this moment whether Mommy D's husband is still alive or not.
If Mommy D's husband is already dead, then there is no legal impediment to tackle about. Mommy D would now have all the right granted to her by law to marry any person (he must have the legal capacity to contract a marriage also).
