The Crime of Grave Scandal

When I opened my facebook yesterday, June 2, 2014, a strange news caught my attention.  This news was all about two men caught in the act masturbating.  Thus:

DUHA ka lalaki ang gibalhog sa selda sa San Pedro Police Station human nasakpang nag-masturbate sila ala 1:25 sa kaadlawon kagahapon, Dominggo, didto sa Palma Gil Street, siyudad sa Davao.

Ang duha gitago sa pangalan nga Marco, 33, ulitawo, laborer, nagpuyo sa San Juan Village, Bangkal, Barangay Talomo Proper, ug Daryl, 23, ulitawo, sales agent ug residente sa S.I.R, New Matina, Barangay 76-A Bucana.

Gisaysay sa blotter sa kapulisan nga nadakpan ang duha sa nagpatrolya ang mga sakop sa Philippine Civic Crime Monitoring Group (PCCMG) nga gipangulohan Jerry Balobar Ponayo didto sa dalang Palma Gil.

Si Police Officer (PO2) Perfecto Tuloy, duty desk officer, nagsulti nga nakita mismo ni Ponayo ang duha nga nagbinatilay sa ilang kinatawo kilid sa gi-parking nga multicab sa kalsada.

Dihang gisita sa pulis, miangkon si Marco sa ilang gihimo sanglit bayaran siya ni Daryl.

Sanglit naghimo sila og iskandalo, gidala sila sa presinto diin nasayran nga bayot si Daryl.

"Siya man ang nanghagit kay bayaran daw ko niya mao tong nagpasalipod mi kilid sa multicab," sulti ni Marco sa pakighinabi sa Superbalita kagahapon.

Samtang gi-masturbate ni Daryl si Marco, iya sab giduwaan ang iyang kaugalingon nga kinatawo.

Si Daryl nagsulti nga di tinuod nga iyang gidala si Marco lugar, apan nagkaabot lang sila didto.

Sa kasamtangan, temporaryong gibalhog sa selda sa San Pedro ang duha samtang giandam ang kasong public scandal batok kanila.

Going back to the actors of the instant case, what would be their liability, if any?

Masturbating is not a crime per se.  In fact, any person has all the right to do it.  However, this right is not absolute.  You could not just have your masturbation anywhere you want to especially doing the same in public places.

Based on the instant case, the actors may have violated the provision of the Revised Penal Code on Grave Scandal.

Accordingly, GRAVE SCANDAL is committed when a person offends against decency or good customs by any scandalous conduct not falling within any other article of the said code.

It is not decent nor acceptable to our customs masturbating in public places.  It does not matter whether the actor be a male or a female or both.  What is important is the person has committed an act which offends against decency or good customs.

Other offenses which are against decency and good customs are:

1. Immoral Doctrines

2. Obscene Publication and Exhibitions

3. Indecent Shows
